Terms and Conditions
The terms and conditions set out below (Terms and Conditions) constitute a binding contract between Gezi Makinesi (Trustee for Magic Break of Tursab 7844-A and the person holding or using a ticket to gain admission to the event known as Magic Break (EVENT) irrespective of whether the ticket was purchased by the person holding or using the ticket and applies to any subsequent holders or recipients of the ticket (Visitor).
Event Tickets
Holding a ticket to Magic Break may only get you an entry into our festival. You, and not us, are solely responsible for making all arrangements including, but not limited to, reservations and travel. Magic Break is not responsible for any problems arising from misinformation in the reservation form.
Entry to the Event Site will be granted upon presentation of an EVENT Ticket, which will be exchanged for a wristband. Wristbands that are lost, stolen, destroyed, or damaged will not be refunded or replaced. Any person found without a wristband may be evicted from the Event Site by the Promoter or Event Staff.
Event Tickets will have your name printed on them. Upon entry to the Event Site, Event Staff will check to ensure the name on your photographic identification documents matches the name on your Event Ticket. If the name on your Event Ticket does not match the name on your photographic identification documents, your Event Ticket will be invalid and you will be refused entry to the Event.
It is possible to change the name on your event ticket. However, participants are responsible for notifying the Promoter of any reservation changes 30 days before the festival date.
Ticket Holders must be 18 years of age or older to attend the event. By purchasing tickets, you represent and warrant to us that you are, or will, be 18 years of age or older by the date of the event. You recognize that no refunds will be given if you are not allowed entry to the event for being under the age of 18.
If the Event is canceled (in whole or in part) by the Promoter as a result of any act of nature; extreme weather; bushfires; war; council or governmental rulings or decisions; actions or decisions of the police or other authorities; cancellation by the Venue owner, lessee or controller; or for any reason outside of the Promoter’s reasonable control, refunds shall be in the Promoter’s sole and absolute discretion.

Search on entry to the Event Site
It is a condition of entry to the Event Site that a search of you and/or your possessions be conducted at the time of entry to the Event Site and at other times if requested by the Promoter or Event Staff. This may include but is not limited to, bag checks, vehicle searches, metal detector tests, and drug detection tests. If you do not consent to such searches, you may be denied entry to the Event Site, or evicted from the Event Site.
Refusal of entry or eviction from the Event
The Promoter reserves the right, without the refund of any portion of the ticket purchase price, to refuse entry or evict any person from the Event Site that: fails to comply with the Event Terms; is under the age of 18; is unable to provide a valid and current photo ID that is sufficient, engages in any illegal activity or behavior, or any activity or behavior deemed by us, in our sole and absolute discretion, to be unsafe and disorderly; including, but not limited to suffering from alcohol or other substance intoxication, crowd surfing, climbing the staging, rigging or other structures at the Event Site; causing damage to property or goods at the Event Site; or acting in a violent, threatening, inappropriate, abusive, aggressive, sexist, racist or discriminatory manner or for any other reason in the Promoter’s absolute discretion. who uses vulgar or abusive language.
The Promoter may deny admission to the Event Site and/or VIP Areas per the Event Terms or otherwise in its absolute discretion. Except where required by law, there will be no refund of any Event Tickets .This includes but is not limited to where there has been a variation to the Event, if you are refused entry to or evicted from the Event Site or VIP Areas by the Promoter or Event Staff following the Event Terms if you fail to attend the Event, if you arrive after the commencement of the Event, if you leave the Event Site before the conclusion of the Event, or if you purchase the incorrect type of Event Ticket.
Festivalgoers will not be permitted entry to the Festival whilst in the possession of the following prohibited items: items that may be used in a dangerous or threatening manner, firearms, knives or weapons of any description (and any other sharp items), glass bottles, illegal drugs, fireworks or explosives.
The Promoter and Event Staff may confiscate any Prohibited Items or any other items which the Promoter, in its absolute discretion, considers may be used in an illegal, unsafe, or offensive manner. Confiscated items will not be returned, replaced, or reimbursed. Any items seized will automatically be destroyed on the spot.
At the Festival, it is forbidden to try to access sections restricted to artists or Festival staff – such as production rooms, green rooms, press rooms, offices, backstage, and working areas – unless under your ticket or credentials. Trying to access these areas may result in your removal from the event and/or exclusion from future events
Festivalgoers must not damage, improperly use or tamper with any public facility or infrastructure at the Event Site, or intentionally or recklessly cause any damage or interference to plants or animals at the Event Site or in the area surrounding the Event Site.
PHOTO/VIDEO POLICY
By taking part in the Festival, festivalgoers consent to be included in any photography, film, and/or sound recordings of the Festival to be used by the Promoter for promotional purposes. Festivalgoers acknowledge that the event may be broadcast or publicized, and hereby grants permission to utilize the holder's image or likeness in connection with any life or recorded transmission or reproduction of the such event. Festivalgoers can nevertheless report any photos appearing in communication material that might cause them any harm to the organizer via magicbreak@gezimakiinesi.com
Festivalgoers may take photos and shoot a video for personal, non-commercial use, with personal cameras (excluding SLR/DSLRs) as long as they are not standing in the press area, obstructing views, or using any sort of device such as a tripod.
All photographers using professional equipment (ie DSLR / anything with detachable lenses) are required to have media accreditation issued by the Promoter to take pictures or video at the Festival.
Photos of artists, musicians, and/or the Event are permitted only on the basis that: 1. images are only used for private and personal use, and 2. images cannot be made available for sale and/or public display.
DRONE use is prohibited without specific written permission from the Festival. Please keep them packed away, if we see you using one of them, we may confiscate it and hold it for the remainder of the event.
Compliance with Laws and Directions
Festivalgoers must follow all reasonable directions of the Promoter and any of its employees, personnel, agents, contractors, and subcontractors (Event Staff), including but not limited to security and bar personnel and directions conveyed on signage at the Event Site, and comply with all applicable laws (including regulations) at all times during the Event.
Liability/Indemnification
Festivalgoers acknowledge that the participant may be subject to extremely loud music and sounds, as well as special effects such as laser lights, strobe lights, flashing lights, a variety of LED, rapidly changing or alternating images, and use of smoke, fog, and pyrotechnics at the Festival.
Festivalgoers understand that the Ticket is a revocable license to attend the Festival for which it was issued, and is subject to revocation and denial of admission without compensation for any reason, including, but not limited to, your attempted or actual violation of any of the rules set forth herein policy or regulations and for any other action taken by you in violation of state law, or that may endanger other Ticket Holders.
Festivalgoers assume any risk and/or danger, known or unknown, foreseeable and unforeseeable, resulting from, or incidental to, the Festival, whether occurring before, during, or after the Event. Participants understand and voluntarily agree that Entry to the Event Site is contingent upon the festivalgoer's voluntary assumption of the risks and dangers, including property damage, personal injury, and economic and consequential loss, howsoever arising at the Event.
To the fullest extent permitted by law, Magic Break shall not be liable for the acts, omissions, or default of those providing services in connection with the Magic Break festival, or for any liability for any injury, damage, loss, delay, or additional expenses which are incurred at or in association with the Event. Festivalgoers agree to waive all legal rights of action against and fully release the Promoter, its agents, employees, and volunteers for all claims for compensation for loss, damage, or injury, howsoever arising out of or in relation to the festivalgoer's entry to, and their attendance at, the Event. In no event will the Promoter be liable for any indirect, consequential, exemplary, or special damages.
Festivalgoer recognizes and acknowledges that there are hazards and risks of physical injury or illness and that not all such risks can be fully eliminated. In the event of injury or illness, the Promoter may, at the participant's cost, arrange medical treatment and/or emergency evacuation as deemed essential for the ticket holder’s safety. Festivalgoers hereby consent to medical care and transportation at his/her cost to obtain treatment that is deemed reasonably appropriate or necessary by the reasonable discretion of the Festival staff, security, police or medical professionals.
